Terms of Service

These terms govern your use of azaffordablerentals.com and the related tenant and owner portals (collectively, the “Site”) operated by AZ Affordable Rentals (“we,” “us,” “our”). By using the Site, you agree to these terms. If you don’t agree, don’t use the Site.

Who can use the Site

You must be 18 or older to apply for housing or create an account. The tenant portal is intended for individuals named on an active lease with AZ Affordable Rentals. The owner portal is intended for individuals or legal entities that have engaged AZ Affordable Rentals to manage their rental property.

Account responsibility

You are responsible for keeping your password confidential and for any activity that happens under your account. If you suspect unauthorized access, contact us immediately at (602) 726-4404 or info@azaffordablerentals.com.

Acceptable use

You agree not to:

  • Submit false information on a rental application
  • Use the Site to harass other tenants, owners, or staff
  • Attempt to access accounts, properties, or data you don’t have permission to view
  • Probe, scan, or test the security of the Site or its infrastructure without written consent
  • Use automated tools (scrapers, bots) to extract data from the Site
  • Upload files that contain malware, viruses, or any other harmful code

Communications

By providing your email address or phone number, you consent to receive operational communications from us about your application, lease, payments, maintenance, and other account-related events. You can opt out of SMS at any time by replying STOP to a text. We may also send required legal notices (e.g., 5-day pay-or-quit, 10-day cure, 30-day termination) via certified mail in addition to or instead of digital delivery, as required by Arizona law (ARS §33-1368, §33-1377).

Listings and availability

Property listings on the Site are provided for informational purposes. Rent amounts, availability, features, and photos may change without notice. A listing on the Site does not constitute an offer to rent. All rentals are subject to application review, screening, eligibility verification (including housing voucher program rules where applicable), and execution of a lease agreement.

Application fees

Application fees are non-refundable. Market-rate applicants pay a $40 application fee at submission. For voucher applicants, fees vary by program (see the Housing Programs page). Fee status (paid, deferred, waived) is shown to staff during review.

Property management services (owners)

Property management services to owners are governed by a separately executed Property Management Agreement, not these terms. Pricing is disclosed at /property-management. These Terms of Service apply only to your use of the Site itself.

No warranty

The Site is provided “as is” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy of any information on the Site beyond our reasonable efforts to keep it current.

Limitation of liability

To the maximum extent permitted by Arizona law, AZ Affordable Rentals shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Site. Our total liability for any claim arising out of these terms or your use of the Site shall not exceed the amount you have paid us in fees in the 12 months preceding the event giving rise to the claim.

Nothing in these terms limits liabilities that cannot be excluded under applicable law, including a landlord’s habitability obligations under Arizona Revised Statutes Title 33, Chapter 10 (Arizona Residential Landlord and Tenant Act).

Third-party services

The Site integrates with third-party services to provide its features:

  • Supabase (database + authentication)
  • Stripe (payment processing)
  • Resend (email delivery)
  • Lob (USPS certified mail)
  • Twilio (SMS notifications)
  • Anthropic (AI assistant)

Use of these services is subject to their own terms and privacy practices. We are not responsible for the acts or omissions of these third parties beyond our reasonable oversight of the vendor relationship.

Changes to these terms

We may revise these terms from time to time. The “Last updated” date at the top reflects the most recent change. Material changes will be communicated to active tenants and owners via email. Your continued use of the Site after a change constitutes acceptance of the revised terms.

Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws provisions. Any dispute arising out of these terms shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona.
